, why all of the love? good morning, welcome to early state. i'm christine rom yans. >> and i'm john berman. it's january 28th it's monday. we'll begin with that developing story out of brazil. deadly chaos at a nightclub. early yesterday morning. killing a staggering 233 people. many of them college students celebrating their last weekend of summer break. it happened at kiss nightclub in santa maria. recovery workers now say they're hearing the eerie sound of ring tones. we're in santa maria with the latest. >> reporter: smoke filled the air when the first firefighters entered the nightclub. where shirtless men were already trying to rescue some of the injured. emergency vehicles arrived not realizing the extent of the tragedy they faced. chaos and terror among survivors and the body of victims all around. the fire broke out at about 2:00 in the morning at a nightclub called kiss in santa maria in bra sail's southern most state. the club was packed with some 2,000 people, twice its legal capacity according to officials >> translator: people who were inside the facility when they cam

in rhode island. it will be ten years next month. that's when 100 people were killed. attorney john barlick represented families. he wrote a book called "killer show." it details that devastating fire, its causes and the heart breaking aftermath. john joins me now from providence, rhode island. we were talking a couple of months ago here at cnn about this book of yours and i immediately, when i saw the news out of brazil, i thought of you, rhode island, the pyrotechnics, the foam you brought in to show us how highly flammable it was. there were many similarities, were there not? >> hello, brooke, yes. this is like a recurrent nightmare. there were many parallel facts, at least as brazil's situation has been reported. >> run through a couple of them. what else? what else was similar? >> well, according to initial reports we have improper use of pyrotechnics in an unsuitable venue, we have flammable wall coverings, we have gross overcrowding as we had at the station. and we have staff that seems woefully undertrained to deal with emergencies. >> i read your opinion piece on cnn.com and you wr

actually indicted john and patsy ramsey in connection with the death. why did the prosecutor decline to try that case? >>> we begin with that tragic nightclub fire in brazil. mike taibbi has the latest. mike, good morning. >> good morning, savannah. it has been a dead lly combinatn in the past, a nightclub filled with revelers and pyrotechnics and few too ways to escape led to panic. in santa maria, it was packed with its usual saturday nightclub when, at 2:00 in the morning, disaster. a swift-moving fire filled the ground-floor club with thick smoke. witnesses said club security initially blocked several emergency exits, thinking p patrons were leaving without paying and that left only a few ways out. in the ensuing panic, some victims were trampled. most died of smoke inhalation. many witnesses told police this fire was triggered by the use of some incindiery device on stage. >> the band used fireworks and as we heard it was usual for this presentation but the ceiling was too short. >> reporter: some club goers who did make it out joined firemen and onlookers in their attempt to open new
testimony from a key witness in the phylicia barnes murder case. the phylicia barnes murder case. >> john lÉopold is accused of misconduct in office. >> hit defense asked the judge to throw the charges out once again. >> the defense rested to date and the judge decided not to toss out the full remaining charges. one thing that did not happen today, and john lÉopold did not take the witness stand to explain his actions. anne arundel county executive john lÉopold and his defense attorneys made no comment while leaving circuit court. the attorneys are saving their final arguments for the judge who must decide whether lÉopold is guilty and if he inappropriately used county money for his own benefit. >> the fact remains that the evidence is out there, the actions were completely irresponsible, immoral, and destructive to county resources. >> former county employee continues watching the case. her lawsuit against the county executive accuses lÉopold of harassment and retaliation. >> people want to know what he was thinking by having police officers try 45 minutes and delivered newspapers.
